(“Lashify," "we," or "us"). 1. HOW WE COLLECT INFORMATION

We collect information from you directly when you interact with our Website, automatically based on your use of our services, and from other sources as described in more detail below.

Information You Provide to Us

We collect the following types of information directly from you.

  • Account Creation. To create an account with us, we ask you to provide your full name, email address, and password. You may optionally also provide a more detailed profile, including a profile photo, date of birth, eye color and shape, skin color, preferences, and information about the Lashify products you use.
  • Purchases. We may collect personal information and details associated with your purchases, including phone number, payment and shipping information. Any payments made via our Website are processed by third-party payment processors. We do not directly collect or store any payment card information entered through our Website, but we may receive information associated with your payment card information (e.g., your billing details).
  • Your Communications with Us. We may collect personal information, such as your email address, phone number, or mailing address when you request information about our services, register for our newsletter or loyalty program, request customer or technical support, or otherwise communicate with us. With your permission, we may send you text messages about our store, new products, and other updates, such as checkout reminders.
  • Surveys. We may contact you to participate in surveys. If you decide to participate, we may collect personal information from you in connection with the survey. 
  • Interactive Features. We and others who use our Website may collect personal information that you submit or make available through our interactive features (e.g., commenting, posting, and review features). Any information you provide using the public sharing features of the Website will be considered “public,” unless otherwise required by applicable law.   • Sweepstakes or Contests. We may collect personal information you provide for any sweepstakes or contests that we offer. In some jurisdictions, we are required to publicly share information of sweepstakes and contest winners.
  • Biometric Information. If you consent to our collection of biometric information, you agree that we may collect a scan of the facial geometry around your eye in order to allow you to try on lashes in a virtual environment. Note that we only collect your eye shape and color, and do NOT collect your iris, retina, or any other information for the purpose of identifying you in the real world. Your biometric information may be shared with our service providers solely to operate the service. Where required by law, we will delete your biometric information within three years from your last interaction with our Website.

We will not ask for or request sensitive information such as government identifiers, medical information, or financial information (except in connection to payments). Please do not provide this information to us through e-mails, feedback forms, or in any other way unless specifically requested.

Information Generated from Use of the Website

We also collect certain technical information automatically when you access, browse, and use our Website, including information that we receive and record from your browser or mobile platform on our server logs. This technical information helps us operate and provide our Website to you, and includes standard information about visits and system capabilities, such as:

  • information about the device(s) you use to access our Website, including MAC address, IP address, browser type and version, your location, time zone setting, browser plug-in types and versions, operating system and platform, device type, device and application identifiers, operating information, mobile carrier, and cookies;

These features may collect personal information such as your IP address and which page you are visiting on our Website, and may set a cookie to enable the feature to function properly. Information from Other Sources

We may receive certain information about you from the organizations or entities on behalf of which we provide the Content to you. That said, we may share information with third-party advertising partners for the purpose of promoting our services as described above. To the extent that such sharing is considered a “sale” under California law, you may limit such sharing by sending us an email at privacy@lashify.com, and by taking the steps outlined in the section “Your Choices” below to limit your use of cookies.

When contacting us, please indicate your name, address, email address, and the nature of your request. Please note that there is no charge for controlling the sharing of your Personal Information or for processing this request. We will process such requests in accordance with applicable laws. To protect your privacy, we will take steps to reasonably verify your identity before fulfilling your request. These steps may involve asking you to provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, or to answer questions regarding your account and use of our Website. You may also make a verifiable consumer request on behalf of your minor child. Refer-a-Friend and Similar Incentive Programs. As described above in “How We Collect Information,” we may offer referral programs or other incentivized data collection programs. Email Communications

You may have the opportunity to receive certain communications from us related to our Website. Unfortunately, no system can guarantee complete security of your information. As a result, Lashify cannot ensure or warrant that your information is secure from unauthorized third parties. To the maximum extent permitted under applicable law, we do not accept liability for unauthorized access, use, disclosure, or loss of personal information.

You are responsible for protecting your password(s) and for the security of information that you transmit to us over the internet.

If you have reason to believe that your interaction with the Website is no longer secure (for example, if you feel that the security of your username or password has been compromised), you must immediately notify us of the problem by contacting us. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on our Website, by mail, or by sending an email to you.

 

8. CHILDREN

Our Website is directed to and is intended to be used only by persons who are 18 years of age or older. We do not knowingly collect information from children under 18.
